 DEFINITIONS

  • ‘HMG’, ‘we’, ‘us’ and ‘our’ refers to House McGrath. 
  • ‘You’ refers to you our customer, who buy from us at our shop or online. 
  • ‘Third party provider’ refers to any one of the companies that we have teamed up with on the HMG website. 
  • ‘Special-Order’ is a made-to-order product and is likely not currently stocked in Ireland. 

GENERAL 

  • When you buy goods from us (online and in our shop), you agree to accept all terms and conditions. You are responsible for making yourself familiar with our terms and conditions before purchasing from us. You also agree that HMG and its third-party providers may communicate with you electronically - only for delivery, product and purchase related issues. 
  • We will do our best to accurately display our products, specifically regarding colour and description. The final product may differ slightly from the images shown. 
  • All offers, in store or online, are subject to availability. If any item/s you ordered are not immediately available or are not available at all, we will inform you as soon as possible. 
  • HMG cannot be held responsible for third-party providers and the service/s they provide.
  • We may change or withdraw any part of our website or may refuse you access to the website at any time, should we consider it necessary.
  • These terms are governed by the laws of the Republic of Ireland and any disputes will be decided only by the courts of the Republic of Ireland. 

PRICING

  • The stated prices on our website are quoted in Euros and are VAT inclusive. 
  • Our prices are fixed, and we do not negotiate discounts on the advertised/ displayed price. 

DELIVERY POLICY

For furniture bought in store and online:

  • Larger items of furniture bought in store are only eligible for delivery and cannot be taken from the shop the same day due to health and safety commitments.
  • Delivery is managed by a specialist third-party furniture delivery company. They will contact you by phone to arrange a suitable time for delivery.
  • It is your responsibility to ensure the way is clear for your piece to be delivered and to check the dimensions of the piece will clear all doorways and tight spaces. Please notify us before delivery if there are any steps involved.
  • Additional fees will apply for non-ground floor deliveries. Please arrange for non-ground floor deliveries directly with our third-party delivery company. Payment can be made at time of delivery.
  • You must inspect the goods delivered to you to ensure that they are in good condition, not damaged and are the goods you ordered. If you are satisfied, you must sign the delivery documentation. 
  • Visibly damaged furniture or incorrect items should not be accepted and the reasons for non-acceptance should be written on the delivery documentation. Please advise us immediately so we can attend to the issue.
  • We will arrange for delivery to the primary address provided by you. We will not be responsible for any loss or unauthorised use of the goods once the delivery has been made and the relevant documentation signed. 
  • Furniture must be accepted for delivery within 4 weeks of purchase. Failing that, a weekly charge will be imposed for storage. Find out more about our storage fees below.

For goods (non-furniture) bought in store and online:

  • Goods are delivered by Fastway and are tracked.
  • If the incorrect item(s) are delivered, you must notify us within 7 days. We cannot be responsible for incorrect deliveries after this time.
  • If you do not receive your goods order within 1-2 working days from date of shipment, please notify us within 7 days. We cannot be responsible for lost deliveries after this time.

RETURN POLICY

For furniture bought in store:

  • Furniture bought in store is not eligible for return, unless flawed or damaged upon delivery, and at our discretion. Please see Delivery Policy for more information.
  • Most furniture items are restored antiques and will have marks of wear and tear which add to the character of the individual pieces. They are restored by hand. Items that are painted, are painted by hand. Occasionally tiny splatters of paint, previous paints colours and areas of imperfection occur. These do not constitute a flaw or damage.

For goods (non-furniture) bought in store:

  • Eligible returns will be exchanged or receive shop credit only.
  • Goods bought in store may be returned within 7 days of receipt with proof of purchase.
  • Goods sold at a discount are not eligible for return.
  • Goods must be returned in the original condition that they leave the store. This includes any labels and packaging.
  • HMG reserves the right to refuse a refund if the item is not returned in a manner that allows for immediate resale.

For furniture bought online:

  • Furniture bought online may be returned within 14 days of delivery. The purchase price of the item(s) will be refunded. Our delivery fees are ‘non-standard’ so cannot be refunded. After 14 days, furniture bought online is not eligible for return and refund.
  • Furniture sold online at a discount is not eligible for return.
  • Return of furniture must be managed by the original third-party delivery company.
  • You will be responsible for the return delivery fees. Our outgoing delivery fees are subsidised, so return delivery fees are subject to third party charges.
  • Furniture must be returned in the original condition that they leave the store. This includes any labels and packaging. Furniture that has been used or assembled will not be accepted for a return.
  • HMG reserves the right to refuse a return if the item is not returned in a manner that allows for immediate resale.

For goods (non-furniture) bought online:

  • Goods bought online may be returned within 14 days of delivery at your expense, excluding goods bought at a discount.
  • Goods must be returned in the original condition that they leave the store. This includes any labels and packaging. Goods that have been used or assembled will not be accepted for a return.
  • HMG reserves the right to refuse a refund if the item is not returned in a manner that allows for immediate resale

STORAGE

  • HMG does not offer storage services.
  • We do not accept responsibility for furniture and goods not collected or delivered after four weeks of purchase.
  • After four weeks, it will be moved by a third-party company and kept at our warehouse at a charge of €50 per week, plus third-party company expenses, admin fees and VAT. These fees are payable by you before delivery. HMG is not liable for these charges.
  • HMG does not take responsibility for your items after these four weeks, this includes loss or damage by moving, fire, flood, theft, or weather.

OUR RESPONSIBILITY

  • We will not be responsible for any losses resulting from your use or the inability to use our website or resulting from unauthorised access to, or alteration of your transmissions or data in circumstances which are beyond our control.
  • We will not be responsible for your loss of profits, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong.
  • You will be responsible if you use this website in breach of these terms of use and will reimburse us for any loss that you cause to us as a result of your misuse.
  • We make no promise that our website will be uninterrupted or entirely error free. Because of the nature of the Internet, the shopping online service is provided on an ‘as is’ and ‘as available’ basis.
  • We are not responsible to you if we are unable to provide our Internet services for any reason beyond our control. This does not affect your statutory rights as a consumer. 

COPYRIGHT / TRADEMARKS / DATA PROTECTION

  • All rights in the designs and information on our website are owned by us. They are protected by copyright, trademarks, and other intellectual property rights.
  • You may view, copy and print portions of our website for the sole purpose of placing an order with us. The materials on our website may not be used for any other purpose.
  • We will use the information which you provide and the records of items you buy to constantly monitor and improve our service and for marketing purposes in accordance with our Privacy Policy.
